Ineligible Applicants

ASF does not accept or will cease processing applications from any enterprise or person who, prior to or during the processing of an application:

• Is bankrupt or being wound up, is having their affairs administered by the courts, has entered into an arrangement with creditors, has suspended business activities, is subject to court proceedings in relation to those business activities, or is in any analogous situation arising from a similar procedure provided for in the laws and regulations of Pakistan or any other country;

• Has been convicted of an offence concerning professional conduct, fraud, corruption, involvement in a criminal organisation or any other illegal activity by a judgment that has the force of res judicata (against which there is no right of appeal);

• Is guilty of grave professional misconduct proven by any means that ASF can justify;

• Has not fulfilled obligations relating to the payment of taxes or social security contributions provided for in the laws and regulations of Pakistan;

• Has been declared to be in breach of contract for failure to comply with contractual obligations in connection with any procurement or grant procedure similar to that offered by ASF;

• Is subject to any conflict of interest arising from the application or the subsequent implementation of the activity financed by an ASF grant;

• Is guilty of misrepresentation in supplying information in any ASF grant application;

• Has tried to influence ASF staff in the process of evaluation of their application;

• Is for any reason deemed to be ineligible for receipt of ASF grant support by the Government of Pakistan or ADB;

• Is a member of the General Body, the Board of Directors or the staff of ASF, or an employee of any Government or related institution, or, in the case of an organisation or enterprise, is subject to majority ownership by the government of the Borrower.

If ASF determines at any time during the processing of the application or subsequent to the disbursement of a grant that the applicant is ineligible according to the above criteria, it may immediately cease processing the application or take appropriate steps to recover any funds already disbursed from the grantee.
